Terms and Conditions of Use for Gruitwa Kart Private Limited

Welcome to Gruitwa Kart Private Limited ("Company," "we," "us," or "our"). By accessing or using our website and/or mobile application (collectively, the "Platform"), you ("User," "you," or "your") agree to comply with and be bound by these Terms and Conditions ("Terms"), which constitute a legally binding agreement under the laws of India. If you do not agree with these Terms, please do
not use our Platform.
These Terms govern all access to and use of our Platform and the services offered through it, including the purchase of physical products sold by registered vendors. The Platform does not offer any services for sale; it solely facilitates the sale and purchase of physical products.
1. Acceptance of Terms
By registering on or accessing any part of the Platform, you indicate that you have read, understood, and agree to abide by these Terms as well as our Privacy Policy and other policies that may be published on the Platform from time to time. These Terms represent a complete and binding
agreement between you and Gruitwa Kart Private Limited.
2. Eligibility
To access or use the Platform, you must be at least 18 years of age. By using the Platform, you confirm that you meet the legal age requirement and have the legal capacity to enter into binding agreements under Indian law. If you are using this Platform on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.
3. Platform as a Marketplace
Gruitwa Kart Private Limited operates solely as an e-commerce marketplace that connects customers with independent vendors who sell physical products and accessories. Our role is limited to providing the technological platform; we do not own, create, sell, resell, control, or manage any of the products listed by vendors on our Platform.
3.1 No In-House Inventory
We do not keep or manage inventory. All products listed on the Platform are offered directly by independent vendors, and these vendors bear sole responsibility for the quality, accuracy, and completeness of the products listed and sold.
3.2 Vendor Responsibilities
Vendors registered on the Platform are independent sellers who control their product listings and maintain their own inventory. Vendors are fully responsible for the fulfillment of orders, including shipping, quality assurance, and post-sale customer support. Customers are encouraged to contact
vendors directly for issues related to warranties or other post-sale concerns.
4. Account Registration
To purchase products on our Platform, you may be required to create an account by providing accurate and complete information as requested. You agree to maintain the confidentiality of your account credentials, including your username and password. You are responsible for all activities
conducted through your account. If you suspect any unauthorized use of your account, please notify us immediately.
5. Data Collection and Privacy
We are committed to protecting your privacy and the security of your personal information. Our Privacy Policy governs our data collection, use, and disclosure practices. By using the Platform, you consent to the collection and use of your personal information in accordance with our Privacy Policy
and in compliance with applicable Indian data protection laws.

Authorized personnel within our company manage and protect user data under strict confidentiality agreements. 6. Return and Refund Policy
Our return and refund policy are as follows:
6.1 Return Period
Products may be returned within three (3) days from the date of receipt, subject to the conditions
outlined below.
6.2 Required Documentation
To request a return, you must provide photographic and video evidence of the product’s condition at
the time of the return request.
6.3 Verification Process
Upon submission of a return request, our team will review the claim. If the return is approved, a refund will be initiated within seven (7) business days from the date of verification.
6.4 Exceptions and Limitations

6.5 Vendor Involvement
As a marketplace facilitator, Gruitwa Kart Private Limited coordinates with vendors regarding returns but does not assume responsibility for any vendor policies. The vendor has sole discretion over the return and refund of the products they offer. Our role is limited to facilitating communication
between the customer and vendor as necessary.
7. Vendor Payment Policy
Payments to vendors are processed after the successful delivery of products and confirmation that there are no outstanding disputes regarding the transaction. Payments to vendors will be released within twenty (20) business days of order completion. Any issues related to product delivery or disputes arising from a transaction must be communicated
to Gruitwa Kart Private Limited within a reasonable timeframe.
8. Prohibited Uses
When using our Platform, you agree to adhere to applicable laws and refrain from:
• Engaging in any unlawful activity or behavior that could disrupt or compromise the Platform.
• Misrepresenting your identity or impersonating any individual or entity.
• Introducing viruses, malware, or other harmful code.
• Accessing or using any portion of the Platform in a manner that could negatively impact its
performance or security.
Any violations of this section may result in the termination of your account and, if necessary, legal
action.
9. Intellectual Property Rights
All intellectual property on the Platform, including but not limited to trademarks, logos, designs, images, and software, are the property of Gruitwa Kart Private Limited or its licensors. Unauthorized use, copying, distribution, or modification of any content on the Platform is strictly prohibited.
10. Disclaimer of Warranties
The Platform and all content, products, and services offered through it are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to maintain a reliable and high-quality Platform, we do not warrant the accuracy, reliability, or availability of the Platform or any content provided by vendors. All product-related warranties and guarantees are solely the responsibility of the vendors.
11. Limitation of Liability
To the fullest extent permitted by law, Gruitwa Kart Private Limited disclaims any liability for indirect, incidental, or consequential damages arising from your use of the Platform or the purchase of any products. Any claims or disputes relating to a product should be directed to the respective vendor.
12. Indemnification
You agree to indemnify, defend, and hold harmless Gruitwa Kart Private Limited, its directors, officers, employees, and agents from any and all claims, liabilities, damages, and expenses arising from your use of the Platform or your breach of these Terms.
13. Modifications to Terms
We reserve the right to amend these Terms at our discretion. Any changes will become effective upon posting on the Platform. Continued use of the Platform following such posting indicates your acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
